You represent and warrant that you own or have the necessary rights to submit the User Content and grant the license described above.
7. Prohibited Conduct and Content
You agree not to submit, post, transmit, or otherwise make available any content or engage in any conduct that:
- Promotes hate, racism, discrimination, or harm against any person or group
- Harasses, threatens, stalks, or advocates harm toward others
- Includes spam, chain letters, bulk messaging, or unsolicited promotions
- Is false, misleading, defamatory, obscene, or unlawful
- Infringes copyrights, trademarks, or other intellectual property rights
- Distributes pirated or unauthorized media
- Includes hidden pages, restricted access content, or deceptive redirects
- Exploits or solicits minors
- Provides instructions for illegal activities, including hacking or creating malware
- Requests sensitive information for commercial or illegal purposes
- Runs sales, promotions, contests, affiliate schemes, or fundraising without prior written consent
Fusicology may remove any content that violates these Terms or that Fusicology determines, in its discretion, is inappropriate.
8. Copyright Policy
You may not post or distribute copyrighted content without permission from the rights holder.
If you believe content on the Services infringes your copyright, please contact contact@fusicology.com with enough information for us to locate the content and evaluate the claim. Fusicology may remove content and take appropriate action, including restricting repeat infringers.
9. Third-Party Links and Services
The Services may include links to third-party websites, platforms, ticketing partners, or services. Fusicology does not control and is not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to the third party’s terms and policies.
10. Disclaimers
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Fusicology disclaims all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Fusicology does not guarantee that the Services will be uninterrupted, error-free, secure, or free of harmful components.
Fusicology is not responsible for inaccurate, incomplete, or unlawful content submitted by users, or for conduct by users online or offline.
11. Limitation of Liability
To the fullest extent permitted by law, Fusicology and its affiliates, partners, licensors, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost data, business interruption, or reputational harm, arising out of or related to your use of, or inability to use, the Services.
If a court determines that liability cannot be fully disclaimed, Fusicology’s total liability for any claim related to the Services will be limited to the amount you paid to Fusicology for the Services in the twelve months preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.
12. Indemnification
You agree to indemnify and hold harmless Fusicology and its affiliates, officers, partners, employees, and licensors from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your violation of these Terms, or your User Content.
13. Governing Law and Venue
These Terms and any dispute arising from or related to the Services will be governed by the laws of the State of California, without regard to conflict of law principles.
You agree that any legal action will be brought in the state or federal courts located in Los Angeles, California, and you consent to their personal jurisdiction and venue.
14. Changes to the Services and These Terms
Fusicology may change, suspend, or discontinue any part of the Services at any time.
Fusicology may also update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
